At last Karnataka Assembly election results are out with once again no party getting absolute majority. Being the party with a tally 3 short of majority BJP could muster the support of Independents and is going to form the government. This election could have been avoided if at all the election rules and our Constitution had been suitably drafted. In a democracy everybody has got their right to contest and also we have to assume that the contestants are having only social service as their desire which makes them to contest in elections. Eventhough social service can be done without being in power it is the government position which definitely gives them an edge to service the society in a larger way. Under the circumstances  what we should do when there is hung assembly or hung parliament. Horse trading ?. It is distressing to note that a tamil daily has published that the price of an Independent Karnataka MLA is now nearly 150 Crores!!! . We just cannot take this as a joke and ignore it. Without fire there cannot be fume.  I have a few suggestion to avoid this.

1.One of the ways  is proportional representation in the ministry with  CM candidate being from the party with maximum numbers. This is based on the argument that every candidate contests in the election with the sole aim of serving the public. Merely because his party loses election why he should be deprived of serving the public after winning the election? There should not be threat to the government under any circumstances except when the law and order breaks down. If the performance of the minister is to the liking of the public then it is quite possible that the party to which that minster belongs may be voted to power with majority.  This rule shall be applicable only when there is hung assembly or parliament.

2.  When a party supports the party with maximum MLAs:  When this occurs the President or Governor shall take an undertaking from the party which supports to the effect that they will not withdraw their support to the party which rules. In case if they withdraw their support an opportunity should be given to the candidates who came second in the election and if they extend their support,  the assembly/parliament should continue by replacing the sitting MLAs/MPs with the candidate who came second. We should not stop with this. The partyand the MLA/MP  which withdrew its/their support shall be barred from contesting any election for the next five years. A question may come about practical issues in passage of bills. This can be sorted out if legal luminaries sit and think.

I request the great Indian think tanks to ponder over this and come out with a solution.
